Start with the operator map

Write down who controls the character, who produces the files, who speaks for the advertiser and who publishes each placement. A virtual influencer can involve a character owner, animation studio, voice performer, agency, media buyer and brand. Calling all of them the creator hides the approvals that can stop delivery.

The brief should name one accountable contact for claims, one for character continuity and one for final acceptance. It should also state whether the character is endorsing from fictional experience, demonstrating a documented product feature, or simply appearing in a scene. That distinction changes the script and the evidence required.

Separate the asset from its media rights

TikTok describes Spark Ads as advertising that uses an organic post, including a creator's post used with authorization. Its help page also describes setting an authorization duration. That platform permission is one operational layer; the commercial agreement still needs to say which account, post, territory, dates, edits and paid-media uses the parties approved.

FTC staff guidance separately treats payment, free products and other things of value as material connections and advises placing a clear disclosure with the endorsement. A reuse code does not answer what the audience must be told, and a disclosure does not grant reuse rights.

Practical application

Use a six-line deliverables schedule

For every item, record: format and duration; channel and publishing account; due date; included revision rounds; acceptance test; and source files to be handed over. Add a rights line covering organic publication, paid amplification, cut-downs, whitelisting or partnership ads, website use, retailer pages, internal presentations and archive duration. Mark any use not granted as excluded rather than leaving it silent.

A workable example is one 20-second vertical film, two six-second cut-downs and three stills. The character operator publishes the film organically for 30 days. The brand may run the unchanged post as paid media in the United States and Canada for 45 days. New voice lines, face changes, model-training use, sublicensing and perpetual use are excluded pending a new approval.

Practical application

Build approval around claims and continuity

Attach a claim sheet beside the script. For each product statement, identify the advertiser's supporting record and the exact approved wording. Then add character constraints: permitted expressions, wardrobe, relationships, topics and synthetic-media disclosure. The brand approves product accuracy; the operator approves the character; a named final reviewer confirms that the export still contains the required notices.

Set response windows and a stop rule. If feedback arrives after the window, the delivery date moves. If the advertiser changes a substantiated claim or requests a new scene, classify it as a scope change. If a live post contains a material error, identify who can pause paid use, correct the caption and preserve the previous version for the project record.

Close with a rights receipt

At delivery, create a one-page receipt listing accepted files, hashes or filenames, live URLs, authorization expiry, disclosure text, usage window and excluded uses. This is a practical handoff, not a substitute for a signed agreement. It gives the media buyer and character operator the same answer when someone asks six months later whether an old render can be boosted again.
